PUBLIC OFFER AGREEMENT

1. General Provisions

This Public Offer Agreement ("Agreement") governs the purchase of digital products through the online store NuttyHappyHobby available at https://nuttyhappyhobby.com.

By placing an order and/or making payment, the Customer confirms that they have read, understood, and fully accepted the terms of this Agreement.

2. Subject of the Agreement

The Seller offers digital products for purchase, including PDF cross-stitch patterns and related digital content available on the website.

All products are digital goods and are provided electronically. No physical goods are shipped.

3. Ordering Procedure

The Customer independently selects products, adds them to the shopping cart, and places an order by providing the necessary information and completing the payment process.

After successful payment confirmation, the Customer receives access to download the purchased digital files.

4. Price and Payment Terms

The price of each product is indicated on its respective product page.

Payment is made using payment methods available on the website at the time of purchase, including payment through integrated payment systems.

The Seller reserves the right to change product prices without prior notice. The price of an already paid order cannot be changed.

5. Delivery of Digital Products

All products sold on the website are digital goods.

Physical delivery is not provided.

Digital files become available for download electronically after successful payment confirmation.

6. Refund Policy

Digital products that have been successfully provided and downloaded by the Customer are non-refundable.

Refunds are possible only in the following cases:

  • accidental payment if the digital product has not been downloaded;

  • duplicate payment for the same order;

  • technical failure that prevented the Customer from receiving the purchased digital product.

Refunds are made using the same payment method that was originally used by the Customer.

The refund period is up to ten (10) banking days from the date the Seller confirms the grounds for the refund.

7. Intellectual Property Rights

All PDF cross-stitch patterns, images, descriptions, texts, and other materials available on the website are the intellectual property of the Seller.

The Customer receives a non-exclusive right for personal use only.

The following actions are prohibited:

  • resale of digital files;

  • transfer of files to third parties;

  • publication of files on websites, social networks, or file-sharing services;

  • any commercial use without the Seller's prior written consent.

8. Dispute Resolution

Any disputes arising from this Agreement shall first be resolved through negotiations.

If an amicable resolution cannot be reached, disputes shall be settled in accordance with the applicable laws of Ukraine.

9. Final Provisions

The Seller reserves the right to amend this Agreement at any time by publishing an updated version on the website.

The version of the Agreement effective on the date of placing an order applies to the respective purchase.

If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect.
